Do I Qualify For Disability Benefits?
The Social Security Administration runs two separate programs for people suffering from long-term disabilities. These programs are known as Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI)
SSDI was created to provide financial assistance to individuals who have been working for an extended time and have already paid into Social Security through income taxes. To qualify for this program, you must have worked at least one year out of every four years you were able to work after turning 21. If you’re age 31 or older, you must have worked at least 20 out of the last 40 years that you were eligible for work.
If you don’t have an extensive work history, or any work history, you may qualify for SSI. This program provides financial assistance to anyone who has a long-term disability and limited financial means, including children, adults, and people over the age of 65.
In certain cases, you may be eligible for both SSDI and SSI. However, the application process will be more complex if you choose to apply to both programs, so we strongly recommend you trust the process to one of our experienced disability attorneys.
What Qualifies as Proof of Disability in New Jersey?
The SSA evaluates disability using 3 pieces of criteria. To prove disability you must show that you:
- Are unable to continue doing the work you did prior to your disability (if you worked previously)
- Are unable to take on any other type of work because of your disability
- Expect that your disabling condition will last at least 12 months or longer
In some cases, you’ll be able to continue your employment while you apply for SSDI, but keep in mind that the eligible income amount is typically capped at $1,350 per month.
