- Prenuptial and postnuptial agreements —These contracts are designed to prevent future disputes over division of marital assets in the event of a divorce by setting out which assets each spouse is entitled to keep. Each partner should have independent legal counsel review an agreement before it is executed to ensure fairness to both parties. We represent spouses of all genders in preparing and reviewing these important agreements.
- Divorce —New Jersey is a no-fault state, which means that either spouse may file for divorce without showing cause if the marriage has broken down without hope of reconciliation for at least six months. There are also divorce grounds based on fault, such as adultery, extreme cruelty, substance abuse, desertion or imprisonment of a spouse. We endeavor to get our clients through divorce with a minimum of distress, achieving the best outcome attainable.
- Property division and maintenance —New Jersey is an equitable distribution state, which means that the courts, in apportioning property and debt, will consider such factors as the length of the marriage, what each spouse brought into the marriage and what each contributed to building up assets during the marriage. Spousal maintenance payments, designed to protect a financially dependent spouse, are usually calculated based on both partners’ earning capacity and the lifestyle they enjoyed while married. We assist in making sure these determinations are fair and reasonable to our clients.
- Child support, custody and visitation rights —New Jersey courts consider the best interests of the child in structuring custody and visitation, taking into account the child’s age and needs and the ability of each parent to meet those needs. The courts also consider the ability of each parent to contribute to the child’s financial support and attempt to provide the child with the same quality of life he or she would have had if the parents had remained married.
