Trusted Disability Lawyers in Cherry Hill, NJ

Experienced

Our attorneys are highly qualified and well-versed in a wide range of Social Security disability matters. With over 50 years of combined experience, our team understands what it takes to navigate the Social Security system and help you secure the benefits you’re owed.

Personal

Working with a large, national firm is enough to make anyone feel small and insignificant. At Rebel Brown Law Group, we work hard to provide the personal attention and care you and your case deserves. It’s this dedication and attention to detail that helps our small firm achieve big firm results.

Affordable

We understand that it can be challenging to afford an attorney while you’re out of work. That’s why we offer free case consultations, and you won’t owe anything until we win. Additionally, we follow SSA attorney fee regulations to ensure you’re never unfairly charged.

Your attorney fees for a disability claim will be a maximum of 25% of your back-pay benefits, or $7,200, whichever is less. This fee can be paid directly from your disability benefits. If your claim is denied, you won’t owe anything.

Hiring a Disability Attorney

Navigating the disability claims process can be stressful and challenging. To make matters worse, any mistakes or omitted information on your behalf can lead to processing delays and denied claims.

For these reasons, it’s crucial to have experienced legal representation on your side as you apply for benefits. Our attorneys have an intricate knowledge of the Social Security Administration (SSA), and we’re dedicated to providing the care and attention it takes to help you secure a positive outcome.

Our team handles everything from collecting medical records and organizing application materials to communicating with doctors and representing you in court. Whether you’re living with a long-term disability or are facing a new condition, our Social Security disability attorneys are here to help you get the support you need.

Best of all, we offer free case consultations, and you won’t be charged until the SSA grants you the benefits you deserve.

How Do I Prove Disability?

To qualify for Social Security disability benefits through the SSA, you must:

  • Be unable to work or do the work you did previously (if you worked previously)
  • Be unable to pursue other work because of your disability
  • Expect your disabling condition to last at least 12 months

In certain situations, you can continue working while applying for Social Security Disability Insurance. However, the amount of income you can earn is typically capped during this time. It’s best to consult your attorney on this matter.

SSDI vs. SSI

The SSA offers two main disability benefits programs—Supplemental Security Income (SSI) and Social Security Disability Insurance (SSDI).

Supplemental Security Income (SSI)

Supplemental Security Income (SSI) is a welfare benefits program that’s available to those who cannot work and do not have a significant source of income from other sources. This program is designed to help anyone that needs financial assistance due to a long-term disability.

Social Security Disability Insurance (SSDI)

Social Security Disability Insurance (SSDI) is another program administered by the SSA. This program was created to assist American workers who are no longer able to work due to a long-term (or lifelong) disability. Unlike other forms of assistance, SSDI aid is funded by Federal income taxes, and only those who have a past work history are eligible for these benefits.

Applying For Disability Benefits

Applying for disability benefits can be complex and time-consuming, which is why it’s important to have a lawyer guiding you along the way. Here’s a brief overview of what to expect from the application process.

Initial Application

First, we complete an initial application for benefits through the Social Security Administration. This application includes various materials such as proof of income, identifying information, medical records, doctor statements, and relevant work history. You’ll typically receive an initial decision on your claim 3 to 5 months after we submit your application. Unfortunately, roughly 90% of applicants are denied during this initial stage, which makes having an attorney all the more crucial.

Reconsideration of Benefits

If your benefits claim is denied, our attorneys will work to file a Request for Reconsideration with the SSA. This request asks the Administration to re-review your initial application. On occasion, the SSA may also request additional medical records or evidence of your condition. About 15% of people who were previously denied are approved in the reconsideration stage.

Benefits Hearing

If your claim is denied after the request for reconsideration, we will request a hearing with an administrative law judge. During this hearing, we will argue the case on your behalf and present any relevant medical evidence.

Unfortunately, it may take up to 24 months to receive a date for your hearing. However, if you reach this stage and urgently need financial assistance, we can ask the SSA to expedite your claim.

Appeals Council Review

Should your claim be denied again at the hearing stage, we will take your case to the SSA Appeals Council. This step is most useful for situations in which we believe the law has been ignored or misinterpreted despite substantial evidence on your behalf.

Our attorneys understand how complicated the application process can be, especially for someone who’s not familiar with the Social Security system. Our team is dedicated to removing the stress and uncertainty from the entire application process so you can rest easy knowing someone is fighting for the benefits you deserve.
